General Terms and Conditions (AGB)

1. Scope

These General Terms and Conditions (“GTC”) apply to all purchases made through the online shop operated by:

(hereinafter referred to as “Seller”)

The online shop offers digital music products, including but not limited to MP3 and FLAC audio files.


2. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order.

By completing the checkout process and clicking the button labelled “Buy Now”, “Order with Obligation to Pay”, or similar, the customer submits a binding offer to purchase the selected product(s).

The contract is concluded when the Seller confirms the order by e-mail or provides the download.


3. Prices and Payment

All prices displayed in the shop are final prices and include applicable VAT where required by law.

Payment may be made using the payment methods offered during checkout.

The customer is responsible for any fees charged by payment service providers.


4. Digital Products

The products offered are digital downloads.

No physical goods will be shipped.

After successful payment, the customer will receive access to the purchased files via download link or customer account.

The customer is responsible for ensuring that compatible software and hardware are available for playback.


5. Copyright and Licence

All audio recordings, artwork, texts and related materials remain the intellectual property of their respective rights holders.

The purchase grants the customer a non-exclusive, non-transferable licence for personal use.

The customer may not:

  • redistribute purchased files;
  • resell purchased files;
  • make the files publicly available;
  • upload the files to file-sharing services;
  • use the files commercially without explicit written permission from the rights holder.

6. Right of Withdrawal for Digital Content

Consumers generally have a statutory right of withdrawal.

However, the right of withdrawal expires for digital content not supplied on a physical medium if:

  1. the customer expressly agrees that the Seller may begin performance of the contract before the withdrawal period expires; and
  2. the customer acknowledges that by giving such consent, the right of withdrawal is lost once performance begins.

During checkout, the customer must explicitly confirm this consent before access to downloads is provided.


7. Availability

The Seller strives to ensure continuous availability of downloads but does not guarantee uninterrupted access.

Temporary interruptions due to maintenance, technical issues or force majeure do not constitute defects.


8. Liability

The Seller shall be liable without limitation for damages resulting from intent, gross negligence, injury to life, body or health, and mandatory statutory provisions.

In cases of slight negligence, liability shall be limited to foreseeable damages typical for the contract.

The Seller shall not be liable for incompatibilities resulting from the customer’s hardware, software or internet connection.


9. Data Protection

Personal data will be processed in accordance with the applicable data protection laws and the Privacy Policy available on this website.


10. Applicable Law

The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

Mandatory consumer protection provisions of the customer’s country of residence remain unaffected.


11. Online Dispute Resolution

The European Commission provides a platform for online dispute resolution:

The Seller is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board unless required by law.


12. Final Provisions

Should any provision of these Terms and Conditions be invalid, the remaining provisions shall remain unaffected.
